What is Products Liability?

Most people assume that the products they buy are safe as long as they are used as the manufacturer intended. Unfortunately, this is not always the case.

  1. Design Defect

At times, a mistake during the design process can have serious repercussions. For example, if a toy designed for babies has a small part that could choke a child, this would be an example of a design defect product liability case.

 

  1. Manufacturing Defect

Perhaps the product is designed with a customer’s safety in mind, but there was a problem during the manufacturing process that made it harmful to consumers. An example of this type of product liability case would be if a car’s airbag system injured a driver because it was not correctly installed.

 

  1. Marketing Defect

Perhaps there are risks involved with using a product, but the company that makes the product does not offer any warning regarding what “could happen.” This is an example of a marketing defect product liability case.
